In the following agreement, "You" means
the person, company, or entity using this waveform library. "We" and
"Us" means Progressive Diagnostics Co., a Texas L.L.C., Metratek, an Oregon Sole
Proprietorship, their sales agents, distributors, suppliers, employees, and contractors.
NO INCIDENTAL/CONSEQUENTIAL DAMAGES: IN NO EVENT
WILL WE BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR
CONSEQUENTIAL DAMAGES ARISING FROM OR CONNECTED WITH THIS AGREEMENT OR YOUR USE OF THIS
WAVEFORM LIBRARY, regardless whether we know or have reason to know of the possibility of
such damages. Some states may not allow exclusion of incidental or consequential damages
and so the foregoing exclusion may not apply to you.
YOUR INDEMNITY TO US: Independent of the foregoing
provision, you agree to defend and indemnify us against, and hold us harmless from, any
and all claims, damages, losses, and expenses of any kind arising from or connected with
the operation of your business or institution. Additionally, INDEPENDENT OF THE FOREGOING
PROVISIONS, you agree that we will not be responsible for claims arising from your
interpretation and/or application of this waveform library.
